1. Acceptance of Terms

By accessing or using the website, services, or programs offered by Faith Perez Dog Training LLC (“Company”), you (“Client”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Description of Services

Faith Perez Dog Training LLC provides professional dog training, and canine fitness and conditioning services. Services may be delivered in-person, virtually, in group settings, or through private sessions, as described on our website or agreed upon in writing.

3. Payment Policy

All services and events must be paid in advance to secure a scheduled session or reservation. By booking a session, Client agrees to the following:

  • Non-Refundable Payments: All payments are non-refundable and non-transferable. Once a session is purchased, no refunds will be issued under any circumstances, except as explicitly stated herein or required by applicable law.

  • Rescheduling: Clients may reschedule a session with a minimum of twenty-four (24) hours’ notice prior to the scheduled start time. Requests to reschedule with less than twenty-four (24) hours’ notice may result in forfeiture of the session without refund.

  • Missed Sessions / No-Shows: Missed sessions or “no-shows” will be forfeited and are non-refundable. No credit, transfer, or make-up session will be provided.

  • Trainer Rescheduling: Faith Perez Dog Training LLC reserves the right to reschedule sessions due to unforeseen circumstances, including but not limited to illness, weather, or emergency. In such cases, the session will be rescheduled at no additional cost to Client.

4. Assumption of Risk

Client understands and acknowledges that working with dogs involves inherent risks. By using our services, Client knowingly and voluntarily assumes all ordinary and inherent risks associated with the Dog’s training and handling, including but not limited to:

  • Bites, scratches, punctures, bruising, falls, and other personal injury

  • Damage to clothing, personal property, leashes, collars, crates, fencing, or vehicles

  • Stress, anxiety, illness, or behavioral regression in the Dog

  • Risks associated with handling, transporting, crating, leashing, or training the Dog

Client understands that they remain the Dog’s legal owner and handler at all times unless otherwise agreed upon in writing. Faith Perez Dog Training LLC reserves the right to end or modify any session if safety concerns arise, without liability.

These assumed risks do not extend to injuries or damages caused by the Trainer’s gross negligence or willful misconduct.

5. Release of Claims and Limitation of Liability

To the fullest extent permitted by New York law, Client, on behalf of themselves and their heirs, personal representatives, and assigns, releases and discharges Faith Perez Dog Training LLC and its owners, members, employees, agents, contractors, and affiliates from any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses arising out of or relating to the training services, the Dog, or Client’s participation in the services, including claims for ordinary negligence.

This release does not apply to claims arising from gross negligence, willful misconduct, or violations of applicable law by Faith Perez Dog Training LLC.

6. No Guarantee of Training Results

Faith Perez Dog Training LLC makes no guarantees regarding training outcomes or the future behavior of the Dog. Client understands and acknowledges that the Dog may continue to exhibit behaviors including but not limited to biting, escaping, causing injury to persons or animals, damaging property, or displaying other unwanted behaviors after training.

Training results depend on many factors outside our control, including but not limited to:

  • The Dog’s temperament, age, health, and prior training history

  • The Dog’s home environment and daily routine

  • Client’s consistency, follow-through, and practice between sessions

Client remains solely responsible for supervising the Dog outside of the Trainer’s direct control and for maintaining all reasonable safety precautions.

7. Veterinary Care and Health Responsibility

It is the Client’s responsibility to ensure the Dog is in appropriate physical and health condition to participate in any training, conditioning, or exercise programs. Prior to engaging in canine strength or conditioning activities, Client agrees to obtain all necessary veterinary or medical approvals.

If at any point during a session the Dog shows signs of weakness, injury, or if a prior injury resurfaces, Client will immediately cease participation and seek appropriate veterinary care. Client agrees to be fully responsible for all veterinary, transportation, and related costs, except to the extent caused by the Trainer’s gross negligence or willful misconduct.

In the event of an emergency where Client is unreachable, Faith Perez Dog Training LLC may seek veterinary care for the Dog at Client’s expense.

8. Client Responsibilities

By using our services, Client agrees to:

  • Provide accurate and complete information about the Dog, including health history, temperament, and any known behavioral concerns

  • Disclose any history of aggression, biting, or reactivity prior to the first session

  • Ensure the Dog is current on all required vaccinations and is free of contagious illness

  • Comply with all trainer instructions during sessions

  • Maintain adequate supervision of the Dog at all times outside of scheduled sessions

9. Intellectual Property

All content on the Faith Perez Dog Training LLC website, including but not limited to text, graphics, logos, videos, training materials, and methodologies, is the intellectual property of Faith Perez Dog Training LLC and may not be reproduced, distributed, or used without prior written permission.

10. Privacy

Any personal information you provide to us will be used solely for the purpose of delivering our services and communicating with you. We do not sell or share your personal information with third parties except as required by law or with your consent. By using our services, you consent to our collection and use of information as described herein.

11. Photography and Media

Faith Perez Dog Training LLC may photograph or record sessions for training, educational, or promotional purposes. By using our services, Client grants Faith Perez Dog Training LLC a non-exclusive, royalty-free license to use images or footage of the Dog for such purposes. Client’s own likeness will not be used without separate written consent.

12. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

13. Changes to These Terms

Faith Perez Dog Training LLC reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services following any changes constitutes your acceptance of the revised terms.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
